JUA threatens lawsuit if state adopts Senate plan
The nonprofit Pa. Professional Joint Underwriting Association (JUA) has threatened to sue the Commonwealth should the Senate fiscal code bill be concurred with by the House and signed into law. The Senate on July 27 passed House Bill 118 that included language to transfer $200 million from the JUA to the General Fund, and sunsets the association “if payment is not made.” Created by the legislature in response to medical liability market instability in 1976, and reauthorized during the establishment of MCARE reforms, JUA serves as an insurer lottery for providers who cannot secure liability coverage through normal means.
